These Terms of Use (the "Terms") govern your access to and use of the website utesto.com and all related services, mock tests, content, and materials (together, the "Service") provided by Utesto ("Utesto," "we," "us," or "our").
By creating an account, purchasing a subscription, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Refund Policy, which are incorporated by reference. If you do not agree, do not use the Service.
You must be at least 16 years old (or the age of majority in your jurisdiction) to create an account and purchase a subscription. If you are under the age of majority, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms. By using the Service, you represent that the information you provide is accurate and that you have the legal capacity to enter into these Terms.
Utesto provides online TOEFL® and CELPIP® mock tests, practice questions, study materials, scoring, and related exam-preparation tools. The Service is provided for personal, non-commercial educational use only. We may add, modify, or discontinue features, tests, or content at any time to improve or maintain the Service.
We do not guarantee any particular examination score or outcome. Our materials are for practice and preparation and are not actual TOEFL or CELPIP examinations, nor a substitute for the official tests.
To access most features you must create an account. You agree to:
Your account is personal to you. You may not sell, transfer, or share it, and you may not allow any other person to access the Service through your account. We may suspend or terminate accounts that are shared or used by more than one person.
5.1 Merchant of Record. Payments for the Service are processed by our Merchant of Record, Paddle.com Market Limited ("Paddle"). When you purchase a subscription, Paddle — not Utesto — is the seller of record for that transaction, handles billing, and applies any relevant taxes. Your purchase is therefore also subject to Paddle's Buyer Terms and Conditions and Paddle's Privacy Policy.
5.2 Subscriptions and auto-renewal. The Service is offered on an auto-renewing subscription basis. When you subscribe, you authorise Paddle to charge your chosen payment method:
5.3 Cancellation. You may cancel your subscription at any time through your account settings or via the management link in your Paddle purchase/renewal emails. Cancellation stops future renewals. When you cancel, you retain access until the end of the billing period already paid for; the subscription then ends and is not renewed. Cancellation does not, by itself, entitle you to a refund of amounts already charged — see the Refund Policy.
5.4 Price changes. We may change subscription prices and plan features. Any price change will apply to your next billing period after reasonable notice, giving you the opportunity to cancel before the change takes effect.
5.5 Failed payments. If a renewal payment fails, we or Paddle may retry the charge and/or suspend or downgrade your access until payment is successfully made.
5.6 Taxes. Prices may be shown exclusive or inclusive of applicable taxes. Any VAT, sales tax, or similar charge is determined and collected by Paddle based on your location.
Our refund terms are set out in full in the Refund Policy, which forms part of these Terms. In summary, because the Service provides immediate access to digital content, fees are non-refundable once the relevant test or materials have been accessed or started, except where a refund is required by mandatory applicable law or in the limited circumstances described in the Refund Policy. Please read the Refund Policy carefully before purchasing.
All content within the Service — including mock tests, questions, answers, explanations, text, graphics, software, design, and branding — is owned by or licensed to Utesto and is protected by intellectual-property laws. Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service and its content for your own exam preparation.

Violation of this section may result in immediate suspension or termination of your account without refund, and we reserve the right to pursue all available legal remedies.
The Service is provided "as is" and "as available." To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will improve your examination results. Utesto is an independent preparation provider and is not affiliated with, endorsed by, or approved by ETS or Paragon Testing Enterprises.
To the fullest extent permitted by applicable law, Utesto shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of (or inability to use) the Service. To the extent liability cannot be excluded, our total aggregate liability to you for any claim relating to the Service shall not exceed the amount you paid to us (via Paddle) for the Service in the three (3) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, misuse the Service, or engage in fraudulent or abusive conduct. You may stop using the Service and cancel your subscription at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws applicable to the operator of Utesto. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved amicably shall be subject to the jurisdiction of the competent courts applicable to the operator of Utesto, except that nothing in these Terms affects your mandatory statutory rights as a consumer, including any right to bring proceedings in the country where you reside.
